Lori Stoltz recently joined Adair Morse LLP from Goodman and Carr LLP, where she was a Partner from 1998 to 2006.
Lori has a wide range of experience at all levels of court and administrative tribunals in Ontario.
Her current practice is in the areas of civil and administrative law, with an emphasis in personal injury and health law litigation and opinion work. Her health law experience includes: medical negligence; product liability pertaining to drugs and medical devices (including class proceedings); regulatory negligence of public authorities; OHIP coverage issues; the regulation of health professionals, health care facilities and institutions (including the ethical conduct of clinical research); public health; health and human rights; and constitutional law.
Lori has had a long-standing interest in HIV/AIDS and public health matters, and has acted on behalf of individuals and organizations in relation to a wide range of HIV-related matters. |

Lori is a member of the Ontario Bar Association (Health Law Section) and the Advocates’ Society, among other professional associations.
She is a current member of the Cohort Study Governance Committee of the Ontario HIV Treatment Network (“OHTN”) and the Editorial Board of the HIV/AIDS Policy and Law Review (a joint publication of the Canadian HIV/AIDS Legal Network and the American Bar Association AIDS Coordinating Committee).
Lori was Chair of the Health Protection Appeal Board from 1993 to 1998, and from April 2002 to December 2003 was Senior Policy Advisor to the Honourable A. Anne McLellan, Minister of Health (Canada). |

“Infant X” v. “Physicians” – Counsel to an infant and family in a precedent-setting case arising from the infant’s avoidable HIV infection due to physician failure to provide HIV testing and counselling to mother.
Health Professions Regulatory Advisory Council – Member of an expert task group established to undertake a comprehensive review of psychotherapy and make recommendations for the regulation of psychotherapy in Ontario.
AIDS2006 Toronto Local Host – Lead counsel to organizers of the 16th International AIDS Conference in Toronto (August 2006), to successfully remove discriminatory self-disclosure requirements from Citizenship and Immigration Canada’s Temporary Resident Application form and related procedures affecting people living with HIV/AIDS and other communicable and chronic illnesses.
Olivieri v. Commission of the European Communities et al. – Counsel to Dr. Nancy F. Olivieri, a clinical researcher and scientist, in a precedent-setting application for judicial review before the European Court of Justice to challenge the licensing of deferiprone in Europe as based on inaccurate and incomplete information from the manufacturer, Apotex Inc.
UNAIDS – Lead counsel to undertake analysis of legal and human rights issues presented by HIV testing of UN peacekeeping forces, prepared for the UNAIDS Expert Panel on HIV Testing in UN Peacekeeping Operations to inform possible revisions to the UN’s HIV testing policy for peacekeeping forces at the request of the Security Council.
North York Branson Hospital – Lead counsel to the North York Branson Hospital Board and Medical Staff Association, to negotiate the transfer of all programs and services from the Branson to North York General Hospital further to directions issued by Ontario’s Health Services Restructuring Commission.
R. v. Cuerrier – Counsel to the Canadian HIV/AIDS Legal Network as an intervenor before the Supreme Court of Canada, in the first Supreme Court case to consider criminal responsibility arising from HIV transmission between sexual partners.
Wellesley Hospital Medical Staff Association – Lead counsel to the Wellesley Hospital Medical Staff Association before, and in response to, directions issued by Ontario’s Health Services Restructuring Commission.
Krever Commission – Lead counsel to the HIV T-Group (Blood Transfused) before the federal Commission of Inquiry into the contamination of Canada’s blood supply with HIV/AIDS and hepatitis, and in related applications for judicial review through the Federal Court to the Supreme Court of Canada seeking to prevent the Commissioner from publishing his report.
Health Action Lobby – Counsel to “HEAL”, a coalition of major national associations of health care providers, to provide an opinion on legal and constitutional options to maintain national standards in the delivery of health care in Canada in the context of discussions leading to the Charolottetown Accord.
